Conflict and Coordination of Birth Right

生育权是一项基本的人格权,是达到法定结婚年龄的男女决定是否生育和如何生育子女的权利。生育与人身有着密切的联系,不能强制执行,只能在男女协商一致的基础上进行,因此,当生育权发生冲突时,应根据不同的情况,依据合同法的基本理论和生育权的属性进行协调。
