Characteristics and Value on the Customary Law of Shanxi Draft Bank

在晋商习惯法的基础上,山西票号习惯法形成了自己的特点:它在国家法之下独立发展,自成体系;以成文法与不成文法为表现形式;继承和发扬了中国传统文化的精华;保持了地域性与普遍性的统一。作为清代习惯法的重要组成部分,山西票号习惯法不仅有效防止了金融风险,保证了票号的发展与兴盛,而且弥补了国家法的不足,并为当代人的法律思考与实践提供了参照。

Based on the customary law of Jinshang(businessmen in Shanxi),the customary law of Shanxi Draft Bank formed its own characteristics.It developed independently and had its own system under the national law.Through two forms(the written and unwritten),it inherited and carried forward the essence of Chinese traditional culture,and maintained the unity of region and universality.As an important part of the customary law in Qing dynasty,the customary law of Shanxi Draft Bank not only prevented financial risks effectively and ensured the development and prosperity of Shanxi Draft Bank,but also made up for the lack of national law,and provided reference for the modern to think and practice the law.
