历史解释是法律解释的一种重要方法,在不同的历史时期有着不同的境遇。在后现代主义的攻击下,历史解释可以在法律解释学之内得以重构,具体表现在含义、论域、操作步骤、解释主体等问题上,其中解释主体的问题是最为重要的。通过对历史解释的研究,可以发现制度之间的和谐关系对法治建设有着重大意义。

As a important method in legal interpretation,historical interpretation has been weighed differently in different periods.Criticized by the postmodernism,historical interpretation can be reconstructed in research on legal interpretation,in such questions as meaning,sphere,operating steps,subject and so on,of which the question of subject stands the top.In the light of studies on historical interpretation,we can see the concordant relation among the institutions is of vital importance to the law.
