人权保障与立法平等

人权是一种为人人所享有的权利。人权保障离不开立法活动,保障人人享有人权需要国家机关在制定规范性法律文件、分配权利义务的过程中承担平等对待的义务。为此,需要把“法律面前人人平等”的约束范围扩大到立法领域,改变以往该原则仅指法律适用上的平等的狭隘理解。

Human rights enjoyed by everyone are guaranteed by the enacting of law,which should conform to the principle of fairness.So the equality before law should be extended from the application to the enacting procedure.
