摘要
回顾对特殊补偿制度出现的背景,对特殊补偿的含义和应用进行了分析,将特殊补偿制度同SCOPIC条款、共同海损等进行对比,列举特殊补偿制度的新发展和趋势,给出完善中国特殊补偿制度立法的建议。
This paper reviewed the background knowledge of the special compensation system,and analyzed meaning and applica- tion of the special compensation.The relationship among special compensation and SCOPIC Clause,General Average,etc.is demonstrated.The new development and tendency of special compensation system are shown,and recommendations are given to perfect China's special compensation system.
