摘要
《物权法》在我国法律体系中是一部非常重要的法律,其中该法第6章所规定的业主建筑物区分所有权有很强的现实针对性,但该章的规定没有明确业主大会与业主委员会的法律地位,这给《物权法》的实现带来了很多问题。本文仔细分析了现行的有关规定,认为目前业主大会与业主委员会的法律地位仍不明确,《物权法》的规定要实现,必须结合实际进行改革。
The Real Rights Law is of great importance in our legal system,in which the regulations of the Owners'Partitioned Ownership of Building Areas formulated in Chapter Six are of great practical significance.However,regulations in this Chapter have not specifically defined the legal status of the owners' meeting and the owners' committee,which caused many problems in the implementation of the Real Rights Law.This thesis expounds the current relevant regulations,coming to the conclusion that the legal status of the owners' meeting and the owners' committee is still clearly defined.As such,the relevant reform should be undertaken for the purposes of the implementation of the Real Rights Law.
