构建和谐社会是一项系统的社会工程,涉及不同的学科和领域,有着不同的建构方式或实现途径,文章旨在探讨法治对于构建和谐社会的必要性和可能性。追求社会和谐,是人类共同的梦想,如果说西方和谐社会追求的是一条法治之路,那么中国传统文化则主要强调的是道德伦理之径。辉煌的西方工商业文明固然不是和谐社会的全部,但它至少可以证明,和谐社会是不能没有法治的;法治对于构建和谐社会的可能性在于,和谐社会与法治社会追求的秩序井然、公平正义、权利保障的价值追求是一致的。另外,从本质上说,社会主义社会就是法治社会。

Harmonious society is systematic engineer referring to various subjects and fields,and it can be realized by diverse means.The paper arms for interpreting necessity and possibility of the harmonious society,which is always mankind s dream.There are different roads to the harmonious society,in which the west chose the rule of law and China preferred to the rule of ethics.The brilliant industry and commerce in civilization of the west shows that the harmonious society cannt be independent from the legals rule.We can arrive at the society of harmony through the rule of law because of their many characteristics in common and the nature of socialism.
