先秦儒家法律思想中的“礼治”及其启示

The "Norm of Etiquette" and its In spiration in the Pre-Qin Legal Thought of Confucianism

先秦儒家以周“礼”思想为源泉提出了“礼治”思想。“礼治”思想主要概括为“亲亲”“尊尊”、“礼不下庶人,刑不上大夫”、“孝忠”思想和“礼法互补,综合为治”等,其根本目的是维护封建宗法等级制度。我们应该正确评价先秦儒家法律思想中的“礼治”思想,取其精华,去其糟粕,以有利于我国社会主义法制建设。

The preˉQin Confucianism takes"ethics"thought of Zhou dynasty as a source and raises the thought of"norm of etiquette".The purpose is to defen d feudal patriarchal hierarchical system.We should have a proper evaluation on t he thought of"norm of etiquette",discard the dross and select the essence,so that it can be beneficial to the construction of socialist law system.
