摘要
刑罚一直被誉为犯罪防治的万灵药,然则,其效力真如所说吗?笔者从刑罚的理论和实践基础方面分析了刑罚的效力问题,最终得出结论,刑罚的效力是有限的,并提出了一系列的修正路径,以求教于同仁。
The punishment is always regarded as the most valuable way to prevent the crime.But is that really valuable?The writer analyzed the effect of the punishment from the theory and the practice foundation,and drew the conclusion:the punishment is limited.Then the writer put forward lots of ways to revise the punishment to be exchanged by the colleague.
