古树名木保护的法律思考

Thought on Legal Protection of Ancient and Precious Trees

目前,我国古树名木保护存在的主要问题有:地方林业主管部门监管不利;保护宣传的力度不够,补偿机制不完善;法律保护制度有待健全。对古树名木资源的保护应更注意其生态价值,将其纳入到环境法保护的范畴之内,在明确其环境资源属性的基础上确定其物权权属、流转及相应的养护、管理措施,以期实现这一资源的可持续利用。

The major problems, unsatisfactory supervision and management of local forestry responsible institutions, small-scale propaganda, and imperfect compensatory system and laws and regulations, now are existing in ancient and precious trees' protection. We should pay more attention to the ecological values of these resources during the protecting process, classify them into the limits of environment law, confirm resources' ownership, circulation and appropriate management and protection on the basis of identifying the attribute of environmental resources, so as to realize their sustained utilization.
