A Brief Discussion on Difficult Problems in Judicial Determination of Kidnapping Crime

绑架犯罪是一种多发性的危害严重的暴力性犯罪行为,目前我国刑事立法虽然对绑架犯罪有所规定,但在司法实践中发现在具体认定绑架犯罪方面存在着一些疑难的问题,这些问题很有必要予以澄清,以契合于有效防范和打击绑架犯罪的现实需要。

Kidnapping crime is a kind of recurrent violent crime with serious hazards. Though our criminal legislation has regulated the crime, there are still some difficult problems about the determination of the crime in judicial practice. These problems should be clarified to meet the needs of preventing and striking kidnapping crime.
