摘要
房屋优先购买权是法定之权,有一定的专属性;它是一种在行使上附条件的形成权,只能在同等条件下行使;它是一种期待权,只有在出卖人出卖其财产时才有可能将可能的利益变为现实的利益;它是一种物权请求权或带有物权性质的请求权,可以对抗第三人;它还是一种限制权。对于房屋优先购买权的冲突,分析法律设定几个“优先购买权”目的及其性质,仍可以作出合理的裁决。
The house purchasing priority is one's legal right. It is a kind of expectation right, a requisition right and also a right of limitation. It analyzes the conflicts and advises that the law must establish a few purposes and natures of priority in order to judge the disputes.
