困境与出路:关于侦查阶段律师权利的考察与反思

Predicament and Outlet: Investigation and Introspection of Lawyer’s Rights in the Investigating Stage

综观国际法律文件及一些发达国家的法律规定 ,律师在侦查阶段都享有丰富的权利。而我国律师在侦查阶段开展业务步步艰难 ,处处受阻。究其原因 ,乃立法赋予律师在该阶段的权利太少 ,并且仅有的一点权利还缺乏保障 ,控辩双方力度严重失衡。因而 ,我国有必要在立法上扩大律师在侦查阶段的权利 ,并进一步加强其权利保障。

Taking a broad view of international legal files and legal provisions of some developed countries, we find that lawyers have lots of rights in the investigating stage. However, it is not the case in our country because the lawyers in China have lots of difficulties to launch business. The cause is that lawyers are not given enough rights. To things worse, the rights are not safeguarded and the power of the prosecutor and the defender is not in balance. It is necessary for our country to strengthen and guarantee the lawyers’ rights in the investigating stage.
