论我国鉴定人制度的完善

On Improvement of the Judge System in China

鉴定人制度是司法鉴定制度的核心,它包括鉴定人资格、诉讼地位、权利和义务等几个 方面。根据我国目前司法鉴定人制度的现状以及借鉴两大法系有关此制度的成功经验,中国应在加强 对司法鉴定人员的资格认证、培训和管理工作以及完善鉴定人出庭作证制度等几个方面进行改革。

The judge system, including qualification, status, rights and obligations, is the core of the judicial identification system. Drawing lessons from the judge system of the two legal systems and faced with the present situation, China should take a series of measures, such as strengthening the qualification authentication to judges and perfecting the system for judges presenting cases in court. This article puts forward a primary framework of establishing the judge system.
