Reform Design of Examining and Ratifying-Arresting System of Chinese Minor Cases

我国未成年人案件审查批捕制度存在诸多问题,导致未成年犯罪嫌疑人的批捕率非常高,这与当前加强对未成年人的司法保护趋势不相适应,改革现行的未成年人案件审查批捕制度势在必行。从我国未成年人案件审查批捕工作的现状出发,分析未成年人案件审查批捕制度存在的问题,借鉴域外相关制度的立法规定及司法实践,提出具体的改革构想。

Nowadays, there are a lot of problems in the Examining and Ratifying- Arresting System of the Minor Cases in our country, which results in the percentage of ratifying and arresting the minor Suspects being very high. It doesn＇t fit the tendency to strengthen the judicial protection for the minors. So the reforming of the present Examining and Ratifying- Arresting System must be enforced. This article proceeds from the current situation of Chinese Examining and Ratifying- Arresting Work. It analyzes the problems in inland Examining and Ratifying-Arresting System of minor Cases and the relative legislative regulations and judicial practice abroad. This article presents the concrete reform designs to perfect our Chinese Examining and Ratifying- Arresting System of the Minor Cases.
