摘要
合同的效力制度是合同法中的重点和难点,对合同的效力要件作出具体而明确规定,将会使《合同法》更具操作性。虽然我国《合同法》未对合同的效力要求件作出具体规定,但我们认为,合同的效力,应遵从于《民法通则》关于民事法律行为一般要件的规定。
The effcctive system of contract is the most important and difficult part in the law of contract. It will make the law of contract more practical to make concrete and definite formulations of the significant elements of contract. Although our government hasn't made conerete formulations yet, the effect of contract must be abided by the prescriptions of general actions of civil cases in the general civil Iaw.
