论精神损害行政赔偿制度的构建

On the Establishment of Administrative Compensation System for Spiritual Damages

国家赔偿法修正案草案前不久终于迎来了全国人大的首次审议,从草案可见,将精神损害纳入赔偿范围是这次国家赔偿法修改的核心内容之一。建立和完善我国精神损害行政赔偿制度正是当务之急。本文应用案例分析方法,分析了现阶段我国立法中精神损害行政赔偿制度缺失给行政相对人带来的救济缺失,论证了我国构建精神损害行政赔偿制度的必要性,提出了建立和完善我国精神损害行政赔偿制度的几点设想。

The draft of State Compensation Law Amendment has recently cleared the council for the first time by the National People＇s Congress. A key amendment of this draft is to specify the compensation for spiritual damages, which is an urgent issue in establishing the govemment＇s compensation system. Through case studies, this article has conducted an analysis of the missing of compensation for the relative person in the current compensation system, discussed about the necessity to establish the compensation system for the spiritual damages, and put forward some suggestions about how to establish the state compensation system for the spiritual damages in China.
