浅析单位犯罪的几个问题

An analysis into problems concering crimes committed by functional units

单位犯罪是指公司、企业、事业单位、机关、团体及其他合法组织违反法律规定，故意或过失实施的危害社会的、依法应受刑法处罚的行为。与自然人犯罪一样，它同样须具备其主体、主观方面、客体和客观方面四个要素；单位可能进行的犯罪活动的类型是多样的，并有扩大的趋势。为此，国家还可在自然人犯罪的犯罪构成要素的基础上，制定一些认定单位犯罪的条件。

By 'offences committed by functional units: is meant the punishable crimes endangering the society accomplished in violence of laws voluntary or involuntary by such functional units as xompaties, enterprises, institutions, official organs, non-govemmental organizations, and other lawful bodies. Like crimes xommitted by natural person, offences xommitted by functional units alsi have such constitrtive elements of crime as the object of crime, the objective aspects of crime, the subject of crime, and thd subjective aspects of crime. In view of the diversification and ever-increasing numbers of offences committed by functional units, the paper is of opinion that China should enact laws that stipulate conditions for cognizance of offences committed by functional units.
