目前我国证券市场违法犯罪情况及刑事立法的思考

The Illegal Crimes in the Secruity Markets of Our Country at Present and Ponderation over Legislation concerning Such Criminal Offences

我国的证券交易市场用10年的时间走过了西方国家证券交易市场百余年所走过的道路,但是,由于尚处于试验起步阶段缺乏应有的管理经验,相关的法律、法规滞后等诸多因素,在证券交易过程中,各种违法犯罪行为时有发生,并表现得日益突出。为了维护"公开、公平、公正"的证券交易原则,使我国的证券市场沿着正确的方向、规范、健康发展,各项法律、法规急待出笼,并发展、完善。

It is ten years that the securities exchange markets of our country have gone through the course that the securities exchange markets in the western countries took more than one hundred years to have gone through. However,as our secuities exchange markets are still at the experimental or beginning stage,they lack the necessary experience of administration and relative laws. There also exists delay of legislation of relative laws and regulations and many other factors. Law-breaking criminal acts of all sorts frequently occur and appear conspicuous increasingly in the course of securities exchange. In order to safeguard the principles of securities exchange—open,fair,just,the relative laws and regulations are eagerly expected to come out and develop to perfection so as to let the security markets of our country develop up to standard and healthily taward the correct direction.
