Legal Relationship between the State and Municipality of the United States and the Implications on the development of China Cities at Prefecture Level

本文在回顾美国州与市的法律关系变迁的基础上,重点考察了狄龙规则和地方自治下美国的州和市的法律关系,并展望未来美国市和州之间关系的发展趋势。本文认为,在地方自治下,美国市政府仍然拥有较多处理地方事务的自主权,二者在权力的博弈中维持动态均衡,这对我国地级市的发展有着很大的启示。

On the basis of the legal relationship between the state and municipality changes review, this paper is focusing on the legal relationship between the state and municipality under Dillon＇ s Rule and Home rule, predicting the relationship between the state and municipality in the future. Under local self - government, municipality governments in the United States still have more autonomy in local affairs, while both try to maintain a dynamic equilibrium, which gives potential implications to the development of cities at prefecture level in China.
