The Study and Evaluation on Criminal Review System of the Song Dynasty

在继承唐代刑事复审制度的基础上,宋代刑事复审制度有了进一步的发展和完善,制度建构更趋合理、缜密,对刑事案件的公正处理起到了积极作用。但同时由于设计过于繁琐以及复审中人治色彩的进一步强化,宋代刑事复审制度也具有一定弊端。

The criminal review system of the Song Dynasty has further developed and been perfected after inheriting that of the Tang Dynasty, with a more reasonable and deliberate system construction. It played a positive role in the fair settlement of the criminal case. However, because of the tedious design and the strengthening rule of man, there present certain drawbacks in the Song Dynasty＇s criminal review system.
