论我国未成年人刑事审判的立法与完善——对最高人民法院司法解释的解读

Analysis on the Legislation Perfect of Minors Criminal Trial of Judical Practice——The Comprehension on Judicial Interpretation of the Supreme People's Court

《最高人民法院关于审理未成年刑事案件具体应用法律若干问题的解释》〔1〕颁布实施以来,众说纷纭,尤其是其中一些内容突破现行刑事法典的规定,具有以司法解释权偷换立法权的嫌疑,更加引发了对该司法解释纵容多于保护的质疑。就此,结合未成年刑事审判的司法实践,对该解释所引发的若干问题进行研究非常必要。
