摘要
我国城市土地归国家所有,可以依法确定给单位或个人使用,因而公民具有对城市土地的使用权。但在我国的拆迁安置补偿过程中,被拆迁人往往处于弱势地位,其城市土地使用权及价值很难实现,这也是开发商与被拆迁人之间纠纷不断的根源。借鉴德国的土地登记制度,我国在土地登记过程中,应该增加公民对城市土地使用权的比例,即房屋居住面积或建筑面积占该宗地总居住面积或建筑面积的比值,确保公民的土地使用权在拆迁安置或土地交易或转让中得到保护和真正的实现。
In China urban land is owned by the state and assigned and transferred to the unit or individual with the provisions of laws and regulation. Therefore, citizens hold urban land use rights. But relocated households are often in the adverse status and their rights of using land are hardly realized in reality in urban house removing. That is also the important reason of conflict between real estate developers and relocated households. For the sake of the realization of urban land use rights, we should reform land registration content with reference to land registration system in Germany, that is, we should increase the content of the proportion of urban land use rights in land registration.
