摘要
我国《就业促进法》关于第27条中的"不适合女性岗位"是消极性保护措施,即外观上是保护条款,事实上也含有限制女性工作权的影像。确定"不适合女性岗位"的范围和种类承载着保障女性权益与保护女性就业平等权的双重使命。遵循性别差异原则、保护与平等均衡原则、形式平等与实质平等兼顾等原则,遵从生理差异分层、职业活动层级和真实职业资格的循序分析应有助于更好地达成上述目标。
"Not suitable jobs and positions for women" is a passive protection measure which protects women's rights,while containing restrictions more or less actually.Defining suitable for women post carries double missions which should balance the protection of women's rights and equality in employment.The principle of gender differences,balanced equality and protection,forms of equality and real equality balance and sequence analysis of layered physiological mechanism,professional activity levels and bona fide occupational qualification help to better achieve above targets.
