论民主制行政法治范式

Administrative Law Paradigm of Democracy

现代宪政对行政法治的制度安排所采用的是官僚制行政范式。在现代社会日益复杂化、高风险的情势下,官僚制行政法治范式表现出深嵌其结构中的内在局限性,其根本缺陷是其在执法过程中有背离执法为民的可能性。民主制行政法治范式以其对现实的有效回应能力和执法为民的价值观契合以人为本的社会主义法治理念。

The modern constitutionalism adopts the administrative law paradigm of bureaucracy to arrange the administrative institution.However,the bureaucracy paradigm,under the high risk and complicated conditions of modern world,shows a great of internal limitation in its structure,whose essential flaw is the possibility of betraying the notion of enforcement law for the people during the procession of enforcing the law.The administrative law paradigm of democracy;on the other hand,combines its effective response ability to the real world,the concept of value of enforcement law for the people,and the socialist idea of rule-of-law of viewpoint of humanist.The paper argues the cause of formation,the function,and the characters of the administrative constitutional paradigm of democracy to combine the above two administrative constitutional paradigms,and studies the formation and characters of the administrative constitutional paradigm of democracy to achieve the basic requirement of enforcenment law for the people of the socialist idea of rule-of-law.
