宽严相济的刑事司法政策,体现了以人为本和公平正义的刑事法治理念,是适合我国当前社会综合治理实际的新思维和理性选择。在借鉴西方监狱理论和寻求中国特色的矫正范式平衡中不断发展的中国现代监狱,正思考着这样的问题:当我们把监狱的教化功能想象和抬高到不切实际的高度时,刑罚其实正在偏离它最本质的东西。我们在新的时代背景下,应吸收当代西方监狱以行刑社会化为主题的监狱改良运动成果,借鉴西方监狱制度发展中的科学要素,谋划中国今后监狱矫正工作的科学发展之路。

The criminal judicial policy of leniency with sternness as aids, manifest humanist and criminal just with government by law idea, is new thought and the rational choice to suit the current social comprehensive order of our country. The Chinese modern jails, which are developing unceasingly learning from the western jail theory and seeking the correction model with the Chinese characteristics, are pondering such question： When we imagine the jail with enlightened function and rise to the impractical altitude, the penalty has actually deviated its essence. Under the new time background, how should we consult the western jail improvement movement achievement with socialization as the subject, accumulate the scientific essential factors develops in the western jail system, and plan the scientific jail correction work path in China from now on？
