论新时期完善我国环境法制的战略突破口

On a Strategic Way of Improving Environmental Law in China

我国资源环境的现状折射出政府环境管理中存在着比较严重的"政府失灵"。对这种"政府失灵"现象进行深入分析,发现其原因在于资源环境法律中缺乏防止这种"失灵"的制度安排。由于法律上缺乏对政府影响资源环境的行政行为的监督和制约制度,政府官员中比较普遍存在的唯GDP的发展观和政绩观难以得到根本转变,资源环境领域里的"市场失灵"因而难以克服。针对这种情况,新时期完善我国环境法制的战略突破口应当是通过立法建立对政府影响资源环境的行政行为的监督和制约制度。只有处于有效的监督和制约下,行政部门才能保持勤政和清廉,积极有效地行使资源环境保护的公共职能。

The current state of resource environment is an indication of governmental failure. The author finds that this failure is due to the lack of a supervision and checking system in environmental laws. Since there is no mechanism to supervise and regulate the administrative behavior of the government in dealing with resource environment, governmental officials tend to pursue higher GDP and political achievements at any cost, leading to governmental failure. Under such circumstances, the strategic way to perfect the environmental law in China is to set up a supervision mechanism through legislation to regulate the government＇s administrative behavior concerning resource environment. Only when under effective supervision and regulation, can administrative departments be honest and diligent, and their functions of protecting resource environment be better served.
