The Adjudicating Suit in Line with the Sprit of Spring and Autumn and Legal Thought

春秋诀狱是中国法制史上的一次重大变革,是汉武帝时期罢黜百家,独尊儒术在法律上的具体体现,对中华法系的法律思想生了巨大的影响。本文拟从西汉时期法制的不断完善以及春秋诀狱的提出过程的具体分析,指出春秋诀狱实际上就是统治者治国思想的巨大转变在法律思想上的具体体现。虽然在一定程度上有利于法治的完善和社会制度的巩固,但却也造成了巨大的负面影响。

Adjudicating suit in line with the sprit of spring and autumn proves the prominent reform in the history of legal system, the concrete embodiment in law of Wudi Empire＇ s Only Confucianism must be made the official orthodox philosophy, and that all other schools of thought should be discredited, which produced grand impact on the legal ideology of Chinese legal system. The essay intended to conduct process concrete analysis via the constant improvement in Western Han Dynasty and the proposing process of spring and autumn sprit to point out the sprit is literally the ruler＇ s maintaining ideology＇ s embodiment in legal thought, it proved beneficial for improvement of legal system and consolidation of social system, yet caused gigantic negative influence.
