我国特有的政治体制决定了法制体系构造将明显具有不同于传统西方的中国特色,统一的权力体系决定了我国对权力的监督与控制属于系统内的特点。一方面,系统内的控制依赖比附技术(遵循先例)可以达到传统理论不能解决的良好效果;另一方面,我们应当利用科学技术尤其是信息技术,将比附技术电子化、简单化,以求在最大程度上取代人工执法,控制权力滥用。

The political system with Chinese characteristics makes it different from that of other countries.The uniform power of our country determines that the supervision by one power against the administrative power is within one system.The control of administrative power calls for new method.Following the previous decisions should be an ideal choice.In order to make it easier and more acceptable,electronic technology should be employed.
