中国传统法律道德性执着于工具手段性、突出司法者的道德性以及崇尚以人情为本的实质正义。这种法律道德性的"定位"非为民族自觉,而是在民族历史文化酝酿过程中构成的内在特色;这在当代的法治建设中构成了某种程度上的中国法制特色之基础。

Chinese traditional law morality emphasizes on the means, the morality of judges and the substantive justice of human feelings oriented. The ＂positioning＂ of morality is not national consciousness but the internal features forming in the process of ethnic historieal culture, which constitutes the foundation of the characteristics of Chinese legal system in the construction of modern Chinese rule of law.
