Consideration of legal expense insurance

诉讼保险制度是发达国家普遍采用的保障公众接近正义,提高整个法治品质的社会制度装置。本文从诉讼保险的法理基础、概念、制度的产生入手,在阐述我国引进这一制度的必要性的同时分析了制度运行的障碍,认为,该项制度的引进是一项系统而复杂的工程,我国目前引进这一制度时机尚未成熟。

Legal expense insurance（LEI）is a social institution to guarantee the civilization to access the justice and to improve legal quality in developed countries. This paper, starting from legal basis, concept and system origins of LEI, discusses the necessity of system import and analyzes operating obstructions. It holds that the import of the system is a systematic and complex project. It is not the proper time to import LEI.
