摘要
惩罚性赔偿制度作为一般民事赔偿制度的例外,在英美法系得到普遍的承认。在我国《侵权法》制定之际,对惩罚性赔偿制度的产生、功能及其不足做浅显分析,对于我国惩罚性赔偿制度的科学建立,尤为必要。
Punitive compensation is admitted universally in Anglo - American Law as an exception of general civil compensation. At the time of developing our Tort Law, it is necessary for the scientific development of Tort Law to analyze the production, the function and the defects of it.
