The Discussion on the Purpose of the Crime with Purpose

目的犯是以特定的犯罪目的为构成要件的一类犯罪,但作为犯罪构成要件的犯罪目的必须限于刑法的明文规定。对于目的犯之目的的本质,犯罪动机说已被我国很多学者所采纳,而且也有不同于犯罪目的说的其他学说的兴起。犯罪动机的本质属性在于其是一种纯主观的心理需求,它不能直接观察测量,只能根据刺激或反应去推测,不具有客观性。

The crime with purpose is a class of crime that the crime is committed with a specific purpose. And the the criminal purpose as the criminal element must be limited to what the law provides. The nature of the motive for the crime is a pure and subjective psychological needs. it can not be directly observed, hut speculated by the stimulation or reaction, and it is of no objectivity.
