法定刑设置之比较性研究

Comparative research on legal punishment setting up

在法定刑设置时，不仅需要在同一犯罪申寻求罪行均衡的平衡点，更要从刑法体系的整体考虑中对不同犯罪进行横向比较，从而达到最佳的立法效果。中国刑法中至少有两处法定刑设置不平衡。本文经过比较分析之後，提出相应的建议，希望对今後的立法和司法实践有所裨益。

When establish legal punishment of every crime, not merely need to seek the equalization point of crime and punishment, but need more horizontally considering on different crimes from the whole criminal law system, in order to reach the best legislative result. In Chinese Criminal Law, there are two out-of-balances at least in legal punishment. After comparative analysis, this text puts forward the corresponding suggestion and hope to benefit the future legislation and justice.
