责任性是现代政府的基本属性,权责一致是现代民主政治的基本要求。然而,由于公共权力存在异化的可能和风险,势必导致权责失衡,产生权力对责任的侵犯或者责任对权力的回避,践踏公共利益,危及政府的合法性基础。人性的弱点与利益的驱动是导致权责失衡的客观因素之一。鉴于此,必须实施宪政,通过法律来制约权力和规定责任来保障权责一致,这也是建立责任政府、法治政府、有限政府的必要条件。

Accountability is a basic attribute of modern government and parity of authority and responsibility is the basic demand by modern democracy. However, the possible dissimilation in public rights may cause unbalance in rights and liabilities and affect the legal basis of the government. Therefore, constitutionalism must be implemented to ensure the parity of authority and responsibility by restricting rights and formulate liabilities.
