陌生人社会的出路——三鹿毒奶粉事件引发的法律思考

Outlet of Stranger Society——Reflections on Incident of Sanlu Poisonous Milk Powder

本文从"陌生人社会"这一社会学概念入手,直面三鹿毒奶粉事件折射出的法律问题。通过系统比较陌生人社会和传统熟人社会之间的差别,笔者认为,替代"个人信任"的"制度信任"呼之欲出。人们对于规则的强烈渴求,使得法治的重要意义再次凸现。唯有法治才能在社会中建立起普遍有效的制度信任机制,以成功实现从熟悉人社会向陌生人社会的转型,避免三鹿毒奶粉类似事件的重演。

This paper interprets the Incident of Sanlu Poisonous Milk Powder in respect of stranger society,the sociology concept.The paper compares systematically the stranger society to acquaintance society,and concludes that the trust system will replace the individual trust.In people's earnest pursuit of regulation,governance by law is of great help to set up a generally effective trust system,and successfully transform an acquaintance society into stranger society,preventing the reoccurrences of other similar tragedies as such incident from happening again.
