近些年受市场经济和旅游业冲击,中国自然文化遗产遭受严重破坏。通过对现阶段我国自然文化遗产经营管理中存在的体制不顺、产权虚置及相关保护性立法效力等级低、可操作性差等问题的阐述,提出建立完善的法律体系、颁布专门的《自然文化遗产保护法》是挽救中国自然文化遗产的必然选择,并对《自然文化遗产保护法》的立法原则、权属制度、管理体制等问题进行了论述。

By discussing the problems of unreasonable system, unclear property right, low - level protective legislation and operation on natural and culture heritage at the stage in our country, proposed it is a inevitable choice to establish a sound legal system and build a specifical law of 《nature and cultural heritage protection act》 to save chinese nature and cultural heritage. At the same time discussed the legalitive principle, ownership system and management mechanism in 《nature and cultural heritage protection act》.
