行贿罪中“给予财物”行为评析

Analysis and Assessment on Offering Property in Bribe Taking

行贿罪的客观方面——"给予财物"行为之现有立法规定已不能适应刑法惩治新型行贿犯罪行为的需要;从新型行贿犯罪行为以及《联合国反腐败公约》缔结的角度入手,文章认为"给予财物"行为应当修改为"给予不正当好处"行为。

The present provision about the objective element in bribe taking--offering property--has not adequately adapted to the new offenses forbidden by the criminal law. Starting from the new wrongs and the making of The United Nations＇ Convention of Anti--Corruption, the paper thinks that it should be amended as offering illegal benefits.
