摘要
随着时代的发展,英美法的替代责任和大陆法的雇用人责任的价值取向日益偏重于加大雇主责任,保护无辜受害人。为适应其扩大适用范围的现状和发展趋势,该项法律制度在两大法系的理论和实务中通过对传统雇用关系做出扩大解释,突破了其原有涵义,使替代责任或雇用人责任发展为使用人责任成为必然。
With time development, the value of the vicarious responsibility in Anglo-American law system and the employer' s responsibility in Chinese law system increases the burden of employer's responsibility, which can protect the innocent victim effectively. Adapting to the current situations and trends, the traditional employ relationship had-been explained extensively in principles theory and practice of the two fundamental laws, which broke through original meaning and made the vicarious responsibility or the employer' s responsibility develop the user's responsibility inevitably.
