摘要
在线交易后,经营者延迟履行合同、瑕疵履行义务的事情时常发生,中国法律应规定适当的最长履行期限和冷却期。在经营者违约情况下,网络交易平台提供商是否应承担相应的法律责任,取决于其是否违反法定和约定的义务,并且主观上是否有过错。
After on-line business trading, it often occurs that business operators delay or tarnish implementing contracts. The deadline for performance and cooling time should be addressed in a proper way in Chinese laws concerned. When breach of contract occurs on the part of business operators, whether e-commerce business trading platform provider should take on corre- sponding legal consequences or not relies on whether he has breached statutory and contractual obligations and whether he has wrongdoing subjectively or not.
