摘要
《劳动合同法》规定的经济性裁员制度在要求企业慎用裁员权的同时,亦赋予企业通过批量解除劳动合同以摆脱经营困境的权利。在企业因经济危机而陷入经营困难或致劳动合同无法履行时,正确理解并恰当运用《劳动合同法》的经济性裁员制度应是企业的首选方案。而任何试图规避法律的裁员方案不仅无助于企业实现裁员的目标,亦会因违法而增加裁员成本,损害企业声誉。
Enterprises are not only required to use employer's right of dissolving contract cautiously under economic dismissal system defined in Labor Contract Law, but also be entitled the right of getting away from the business predicament via batch dissolving labor contracts. Correctly understanding and applying economic dismissal appropriately should be the preferred option when enterprises encounter serious difficulties in production and business operation under economic crisis situation. Any layoffs which try to elude the law would not help achieving its objective; conversely, it will lead to the increase of layoff cost and hurting the corporate reputation.
