Studies on the Relationship of Procuratorate,Procuratorial Power and Prosecutors

检察机关恢复重建以来的30年,我国检察事业蓬勃发展,检察理论研究也日趋繁荣,出现了一批全国性的检察理论研究组织和学术团体,培养了一支稳定的检察学理论研究队伍,检察学作为一门独立学科的条件日益成熟。但是,理论界对检察学理论体系的观点各异,难以形成一种具有说服力的通说,这一定程度上影响了检察学在学界的认同与关注。笔者将检察院、检察权、检察官作为检察学的基本范畴,运用系统论的方法分析检察学的基本范畴的相互作用与相互关系,并在此基础上构建统一的检察学的理论体系。

Since the restoration and reconstruction of Chinese procuratorial institution in 1978, Chinese procura-torial work has been developing flourishingly with the boom of procuratorial theory research, the appearance of numbers of nationwide procuratorial theory research organizations and academic groups, and the formation of a stable prosecution theory research team, which increasingly enables prosecution to become an independent academic discipline. However, theoretical field has different views on the prosecution theory system and it is difficult to form a general doctrine, which, to some extent, hinders it being recognized and concerned by academic circle. This paper, with procuratorial power, procuratorate, prosecutors as the basic categories of prosecution study, tries to analyze the interaction and mutual relations of the categories in prosecution by system theory and, on.which base, to, build a unified theory system of prosecution.
