摘要
教育纠纷的复杂性与司法审查自身的缺陷,都要求教育纠纷解决机制的不断创新性,以解决教育的现实问题。教育仲裁制度的重构能充分发挥作为专家型中立人的专业优势,以非对抗的方式解决纠纷。通过优化教育仲裁委员会的组成,设计学术实体性纠纷仲裁终局性裁定等来完善教育仲裁制度,弥补单一诉讼模式的缺陷。
The complexity of education dispute and the defect of judicial review require constinuous innova- tion of dispute settlement mechanisms to Solve problems in reality. Education arbitration system can give full play to a neutral person as an expert- based professional advantages, non--confrontational approach to settle the dispute. By optimizing the composition of the committee for Education arbitration, design the final determination rules for academic entities to improve the system of education arbitration and make up for de- ficiencies in a single action mode.
