摘要
物权法中明确规定了预告登记制度,它为规范我国的不动产市场提供了法律依据。预告登记是债权的物权化,我国物权法中该条制度的设立从立法技术和司法实践上,都存在显著的不足。文章从预告登记的权利性质、范围、申请、效力等方面进行了阐释,以期充分发挥预告登记制度的功效。
The advance notice registration system is identified in real right law. It becomes the legal foundation to regulate the realty market. This system of has deficiency both in legislative technique and justice practice. The article explains the rights character, range and proposers' effectiveness of the advance notice registration for playing its efficacy.
