The Justifying Process of Constitutional Legitimacy

宪法正当性的正当化过程就是宪法正当性的实现过程,包括宪法产生的正当化和宪法制度内容的正当化两个方面。前者是制宪权的正当化过程,它保障了宪法起点的正当性;后者是国家权力与公民权利的正当化过程,它保障了宪法过程和结果的正当性。

The justifying process of constitutional legitimacy, a realizing process of constitutional legitimacy as well, includes two aspects of justification of constitution coming-into-being and justification of constitutional system content, of which the former, a justifying process of the right of constitution drawing-up, ensures the legitimacy of constitutional starting-point, while the latter, a justifying process of state right and citizen right, ensures the legitimacy of constitutional process and outcome.
