摘要
公共利益和公益诉讼已成为一个国家法制建设进程和水平的标志性概念。从公益诉讼理念和制度的起源出发,将英美法系和大陆法系主要国家的公益诉讼制度进行对比研究,并勾勒出公益诉讼在我国现阶段的发展概况和前景。以比较的视野引申出借鉴的可能,以期在理论和现实两个层面上为我国的公益诉讼制度建构找到可供参考的蓝本和资源。
The public interest and public welfare lawsuit has become the marked concepts of a country＇ s legislative advancement. This paper begins with the idea of public welfare lawsuit system and its origin, has done a contrast research of the main country＇ s pub- lic welfare lawsuit system in common law system and the civil law system, then outlines its development at present and prospect to find the blueprint for reference and the resources on the layers of the theory and the reality in China＇ s construction of public welfare lawsuit system.
