数字技术环境下隐私权保护模式探讨

Discussion on protection mode of privacy right under the environment of digital technology

扩大保护范围、显化保护利益和采取适应性的保护模式是数字技术环境下进行隐私权保护的特殊需求,面对这一极具时代特征的权利保护问题,我国法律呈现出明显的滞后性。通过结合国外的法律保护模式和行业自律模式,提出了我国进行数字技术环境下隐私权保护的努力方向,即强化隐私权的法律地位;制定专门的法律法规;形成先进的行业自律和规范行政监管。

Extending protection scope, making protection interests emergence and taking suitable protection mode are special requirements to protect privacy right under the environment of digital technology. Facing this right protection issue with strong era characteristics, our country＇s law shows obvious hysteresis quality. By combing overseas legal protection mode and industry self-discipline mode ,puts forward our country＇s effort direction to protect privacy right under the environment of digital technology, namely, strengthen the legal status of privacy right, set down special law and rule, form advanced industry self-discipline and standardize administrative supervision.
