略论村委会选举中的候选人问题

Discussion on the Candidates Problem in Village Committee Election

村委会民主选举是村民自治和农村基层民主政治建设的重要内容。1998年的《村民委员会组织法》对村委会民主选举作出了相应规定,但因过于简单和滞后留下了较大的法律漏洞。地方在自行制定的村委会选举的地方性法规或实践操作中,候选人问题如候选人资格、候选人提名、正式候选人的确定以及近几年在各地广泛兴起的无候选人直接选举等方面都存在不合法律规范或民主自治精神之处。因此,有必要加以认真研究,以统一认识,减少选举中的争议,推动农村基层民主政治制度不断走向完善。

Democratic election of villagers committee is an important part of villagers＇ self-governance and rural democratic politics construction. The Organic Law of the Villagers Committee issued in 1998 has some regolations about election of villagers committee, but it left too much space because it was simple and outdated, which caused violation to the law and democracy and serf-governance spirit in the local stipulations and practices concerning the problem of candidates, such as candidates qualification, candidates recommendation, formal candidates＇ confirmation and direct election without candidates that widely accepted in recent years. Therefore, the research on these problems is very necessary to avoid the argument in the election and promote development of rural democratic politics system.
