摘要
"问题专利"可以界定为那些不符合专利授权标准而被错误授予,或者被不适当授予专利权的专利。当前在重视专利数量增长的同时,有必要严格控制问题专利的产生,以不断提高专利质量。问题专利产生主要包括如下原因:审查员审查力度不够、查新手段落后、实用新型和外观设计不作实质性审查以及地方政府专利资助费用与奖励政策偏颇。鉴于问题专利本身存在的诸多弊端,可以通过立法、行政、司法、国际合作等四个层面的努力来加以有效控制。
Questionable patent refers to the patent that does not meet substantiality standard but has been mistakenly granted or unsuitably granted. It is necessary to control the questionable patent to improve patent quality while we focus on the increase in the number of patent application and patent issue. This paper analyzes four origins of questionable patent： examiners, research of prior art, substantiality condition and patent subsidization from government. Due to dozens of disadvantages of questionable patent, we can make efforts to control the negative influence of questionable patent effectively by means of legislation, administration, jurisdiction and international cooperation.
