行政应急责任体系化研究——以突发公共卫生事件应急为例

A Study on the Systematization of Administrative Emergency Duty——A Case in Point of Emergent Public Health Event

行政应急过程中的责任具有多元性。各责任主体都必须担当起应该承担的责任,且应该分工明确、各司其职、协调配合。行政应急过程中,在权力与权利的关系上虽然权力可以克减公民的权利,但是必须遵循法治行政原则、基本人权保障原则、比例原则、政府主导原则。行政应急责任体系的模式选择应当采取以政府主导为主,市场调节为辅。同时应当通过法律层面的程序规范与符合地方性需求的地方性规范的有机统一来实现行政应急责任的体系化,进而符合法治的要求。

The plurality of duty is revealed of duty should shoulder their responsibility in the administrative emergency handling process. Each subject and divide, charge and cooperate in the duty. In the handling process, power can reduce the right of the citizen and should be carried out according to rule-by-law ad- ministrative principle, as well as a guarantee of basic human right, proportional principle and governmentleading principle. The choice of pattern of this system of administrative emergency duty should have the government as the leading role supported by market coordination. At the same time the unity of legal procedure standardization and the local standard conforming to requirement of locality should be present in order to realize the systematization of administrative emergency duty, which further abides by the requirement of rule-by-law.
